From California Environmental Protection Agency: &#8220;The formal Cap-and-Trade rulemaking began with the release of the Staff Report: Initial Statement of Reasons (ISOR).  The ISOR and formal rulemaking materials are available on the cap-and-trade <a href="http://www.arb.ca.gov/regact/2010/capandtrade10/capandtrade10.htm">rulemaking web page</a>. The Board Hearing on this item was held on December 16, 2010.  At the hearing, the Board approved <a href="http://www.arb.ca.gov/regact/2010/capandtrade10/res1042.pdf">Resolution 10-42 </a>directing several modifications to the regulation as written.  As a result, on July 25, 2011, the first Notice of Public Availability of Modified Text and Availability of Additional Documents (<a href="http://www.arb.ca.gov/regact/2010/capandtrade10/candt15daynot2.pdf">First 15-Day Change Notice</a>) was issued.  The public comment period for the 1st 15-Day Change Notice ended August 11, 2011.</p>
<p>On September 12, 2011, staff proposed additional modifications to the regulatory text in the Second Notice of Public Availability of Modified Text and Additional Documents and Information (<a href="http://www.arb.ca.gov/regact/2010/capandtrade10/2nd15daynotice.pdf">Second 15-Day Change Notice</a>).  These modifications addressed comments ARB staff received in the first 15-day Change Notice and are the result of additional staff analysis and stakeholder engagement.  The public comment period for the 2nd 15-Day Change Notice ended September 27, 2011. </p>
<p><strong>On <a href="http://www.arb.ca.gov/newsrel/newsrelease.php?id=245">October 20, 2011</a>, the Board adopted the final cap-and-trade regulation.</strong>  As part of finalizing the regulation, the Board considered the related environmental analysis (i.e. functional equivalent document) and written responses to environmental comments.  The Board also approved the <a href="http://www.arb.ca.gov/cc/capandtrade/adaptive_management/plan.pdf">adaptive management plan</a>.  The final regulation must be filed with the California Office of Administrative Law (OAL) by October 28, 2011.<span id="more-1099"></span></p>
<p>The final rulemaking package will include the Final Statement of Reasons (FSOR).  In the FSOR, staff will respond to comments received on the record during the initial 45-day comment period, comments presented at the December 16, 2010 Board hearing both orally and in writing, comments received during the first 15-day Change Notice and the second 15-day Change Notice.  The Administrative Procedure Act only requires that staff respond to changes that are noticed.  Once final, those documents will be posted on the rulemaking web page.&#8221;</p>

			<content:encoded><![CDATA[<p>From The Guardian: &#8220;Apple is more secretive about its supply chain in China than almost all of its rivals, according to a new report by anti-pollution activists who accuse the company&#8217;s products of degrading the environment and poisoning workers.</p>
<p>Despite its claim to be a leading promoter of corporate ethics worldwide, the maker of iPads and iPhones came joint bottom among 29 major IT firms in a transparency study drawn up by a coalition of China&#8217;s leading environmental groups.</p>
<p>&#8220;Behind their stylish image, Apple products have a side many do not know about – pollution and poison. This side is hidden deep within the company&#8217;s secretive supply chain,&#8221; claims a statement by the 36 groups involved in the Green Choice Initiative.</p>
<p>Their report – the fourth to look at the impact of global brands on China&#8217;s environment – considers the openness of IT firms and their responsiveness to reports of environmental violations at suppliers.</p>
<p>It follows a series of workplace poisonings, heavy metal contamination incidents and suicides at Chinese factories that supply materials and components for mobile phones and computers.</p>

Neither the surface nor the mass of the earth is growing or shrinking; the inflow of radiant energy to the Earth is equal to the outflow; and material imports from space are roughly equal to exports (both negligible). None of this means that the earth is staticâ€”a great deal of qualitative change can happen inside a steady state, and certainly has happened on Earth. The most important change in recent times has been the enormous growth of one subsystem of the Earth, namely the economy, relative to the total system, the ecosphere.<br />
<span id="more-546"></span></p>
<p>This huge shift from an â€œemptyâ€ to a â€œfullâ€ world is truly â€œsomething new under the sunâ€ as historian J. R. McNeil calls it in his book of that title. The closer the economy approaches the scale of the whole Earth the more it will have to conform to the physical behavior mode of the Earth. That behavior mode is a steady stateâ€”a system that permits qualitative development but not aggregate quantitative growth.</p>
<p>Growth is more of the same stuff; development is the same amount of better stuff (or at least different stuff). The remaining natural world no longer is able to provide the sources and sinks for the metabolic throughput necessary to sustain the existing oversized economyâ€”much less a growing one. Economists have focused too much on the economyâ€™s circulatory system and have neglected to study its digestive tract.</p>
<p>Throughput growth means pushing more of the same food through an ever larger digestive tract; development means eating better food and digesting it more thoroughly. Clearly the economy must conform to the rules of a steady stateâ€”seek qualitative development, but stop aggregate quantitative growth. GDP increase conflates these two very different things.</p>
<p>We have lived for 200 years in a growth economy. That makes it hard to imagine what a steady-state economy (SSE) would be like, even though for most of our history mankind has lived in an economy in which annual growth was negligible. Some think a SSE would mean freezing in the dark under communist tyranny. Some say that huge improvements in technology (energy efficiency, recycling) are so easy that it will make the adjustment fun.</p>

Buried in most reports is the fact that this particular outbreak of rioting has its genesis in a clash between dominant Han Chinese and ethnic minority Uighur workers in a Hong Kong-owned Guangdong toy factory in late June (which was reported in the Hong Kong press; see <a href="http://hk.apple.nextmedia.com/template/apple/art_main.php?iss_id=20090627&#038;sec_id=15335&#038;art_id=12924858">here</a>, in Chinese only).&#8221;<span id="more-514"></span></p>

I&#8217;ll do an English version for CSR Asia Weekly this week, of which a short version is this: the brawl in late June (in which over 100 workers were injured (16 seriously) and two were killed) is not an isolated incident (although deaths obviously are rare).
